CONTENT
|
You acknowledge that all submitted to scanmyimages materials (negatives, slides, photographic
prints) are your sole responsibility or you have a written permission from the copyright owner
allowing performing the service.
You understand and agree that scanmyimages refuses to perform the service, if the content of
submitted materials is offensive, abusive, pornographic, obscene, threatening, advocating illegal
activity, harming minor, infringing rights of privacy, or other inappropriate material that could
give rise to any civil or criminal liability under applicable state or federal law.
Upon discovery of inappropriate or copyrighted without the written permission materials, they will
promptly be returned at your expense.

INDEMNITY

You agree to indemnify and hold scanmyimages and its owners, directors, employees and partners
harmless from and against any and all costs, damages, liabilities and expenses (including attorneys’
fees and costs of defense) scanmyimages or any other indemnified party suffers in relation to or
resulting from violation of these terms and conditions.

LIMITATION OF LIABILITY
|
We handle all materials throughout the entire scanning process with extreme care. However, if any
loss or damage occurs to the submitted materials while in our possession, our expenses and
restitutions for those materials can never exceed the raw cost of the materials or $100 whichever is
less.
scanmyimages is not liable for the materials while in transit or in possession of the United States
Postal Service or any other carrier. You agree to be liable for any materials, if they are
misdirected, lost stolen or damaged while in transit.
You agree that the submission of photos, slides, or negatives to scanmyimages is done at your own
discretion and risk. scanmyimages does not assume any responsibility for any loss, physical, or
personal damage, or any other type of damage that may in any way result from the use of its products
or services.
Except as expressly provided in the preceding paragraphs, to the fullest extent allowed by law,
scanmyimages and its owners, directors, employees and partners shall not be liable for any direct,
indirect, incidental, consequential, special, exemplary, or punitive damages, even if scanmyimages
has been advised of the possibility of such damages.
scanmyimages posts average turnaround time for performing services, but we do not guarantee that the
service can be performed within any given time period. All image CDs and DVDs are verified prior to
shipping. However, we do not guarantee your ability to view the images nor the appearance of the
images when viewed on your computer or any other device used to view the digital images. Should you
encounter problems viewing the images, additional copies of CDs/DVDs can be sent to you upon
request. Standard media and shipping charges will apply.

PAYMENTS
|
You understand and agree that all submitted to scanmyimages materials will be send back to you after
you pay for the service in full. All orders once processed are final and non-refundable.
All payments are processed using the PayPal service.

DISCLAMER OF WARRANTY
|

The scanmyimages site and all products and services provided through it are provided "as is" with no
warranties whatsoever. All express, implied, and statutory warranties, including, without
limitation, the warranties of merchantability, fitness for a particular purpose, and
non-infringement, are expressly disclaimed. To the fullest extent permitted by law, scanmyimages
disclaims any warranties for the security, reliability, timeliness, and performance of the
scanmyimages site or the scanmyimages service.
